In this Privacy Policy, we provide information regarding the extent to which we process your personal data (hereinafter referred to as just "data").

  2. Data processing

We process data as part of operating our website. Data processing also includes disclosure by means of transfer

Data is transmitted to the USA on the basis of an adequacy decision made by the EU Commission, the EU-US Privacy Shield. In this decision, the Commission certifies that the guarantees for transmitting data to the USA on the basis of the EU-US Privacy Shield are in line with data protection standards in the EU. Insofar as we transmit data to the USA, we have marked out our service providers participation in the EU-US Privacy Shield.

The specific data affected, processing purposes, legal grounds, recipients and transfers to third countries are listed in the following paragraphs:

    1. Log files

We create a log of your visit to our websites. In doing so, we process the following data: Name of the respective website accessed, access time and date, data volume transferred, browser type and version, the operating system used by you, the referrer URL (previous website visited), your IP address and the requesting provider. This is necessary to ensure the security of the website. We process the data on the basis of our legitimate interest in accordance with Art. 6(1) (f) GDPR. The log file is erased after seven days unless it is required for providing evidence for or resolving specific legal violations that have come to light during the retention period.

    2. Hosting

As part of the hosting service, we store all data to be processed in connection with operating this website. This is necessary to enable the operation of the website. We process the data on the basis of our legitimate interest in accordance with Art. 6(1) (f) GDPR. In order to provide our website, we use the services of web hosting providers to whom we transmit the data listed above. We also transmit data to the service provider Instapage Inc., San Francisco, CA, USA ("Instapage"). Instapage is currently undergoing internal review. The page will be adapted within the next few days.

    3. Contacting us

Should you contact us, your data (name, contact details, if provided by you) and your message will be used exclusively for processing and handling your enquiry. We process this data on the basis of Art. 6(1)(b) GDPR or Art. 6(1) (f) GDPR for the purpose of handling your enquiry.

    4. Newsletter

We send out a newsletter in order to regularly provide you with information on our company and our offers. Once you register for our newsletter, we process the data you entered (e-mail address as well as other optional information). The newsletter is sent out after registration on the basis of your consent in accordance with Art. 6(1) (a) GDPR.

Newsletter registration is based on the so-called double opt-in method. To prevent misuse, we will send you an e-mail following registration in which we will ask you to confirm your registration. In order to provide evidence of the registration process in line with legal requirements, your registration will be logged. In particular, the time of registration and confirmation as well as your IP address are stored.

    5. Purchase processing

We process your order data for the purpose of fulfilling the purchase agreement. The data is processed on the basis of Art. 6(1) (b) GDPR.

We transfer your address information to the company tasked with the delivery. Where required to fulfil the agreement, we also send your e-mail address or your phone number to the company tasked with the delivery for the purpose of agreeing on a delivery date (dispatch notification).

We transmit your transaction information (name, order date, payment type, dispatch and/or delivery date, amount and payee, and, if required, bank or credit card details) to the payment service provider tasked with processing the payment.

    6. Website analysis and marketing

In order to make the use of certain functions possible, we use cookies. Cookies are small data packets which are stored on your device and exchanged with other providers. Some of the cookies we use are deleted immediately after you close your browser (session cookies). Other cookies remain on your device and make it possible to recognise your browser the next time you visit (persistent cookies).

You can delete all cookies stored on your device and change the settings on all common browsers to prevent the storage of cookies.

In this case, you may have to adjust some settings each time you visit this website and may not be able to use all functions in full.

We use cookies in connection with the following functions:

      Google Analytics

We use Google Analytics, a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google uses particular cookies for this service. The data generated by the cookie about your use of this website (including your IP address) is sent to a Google server in the USA, where it is stored. We use the stored data to analyse your use of the website, compile reports on website activity for the website operators and to provide further services related to the use of the website. The data we receive in this way is processed by us due to our overriding interest in ideally marketing our online services in accordance with Art. 6(1) (f) GDPR. Under no circumstances will Google link your IP address to other data held by Google.

Please note that this website uses Google Analytics with the "anonymizeIp()" extension. This means that IP addresses are truncated prior to transferring them to a server in the USA. It is therefore generally not possible to link stored data directly to a specific individual. Only in exceptional cases is the full IP address sent to a server in the USA, where it is truncated.

You can object to data collection at any time with future effect, by using the Google Analytics browser deactivation add-on at http://tools.google.com/dlpage/gaoptout?hl=de.

Please also take note of the information on data usage by Google in the Google partner network, available at: http://www.google.com/intl/de/policies/privacy/partners/

    7. Integration of third-party content

We use dynamic third-party content in order to optimise the presentation and offers on our website. When visiting the website, an automatic enquiry is sent to the server of the relevant content provider via an API, during which certain log data (e.g. the users IP address) is transmitted. The dynamic content is then transmitted to our website and displayed there.

We use external content in connection with the following functions:

      1. Integration of YouTube videos

We have integrated YouTube videos from YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA ("YouTube") in our website. When playing the videos, log data is transferred to a YouTube server in the USA. This processing occurs due to our overriding legitimate interest in ideally marketing our offers in accordance with Art. 6(1) (f) GDPR.

        YouTube is certified at: https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active

You can find further information at: https://policies.google.com/privacy?hl=de&gl=de

      2. Google Maps

We use the Google map service "Google Maps" on our website to provide you with an interactive map. When displaying the map, data, including your IP address and your location, is transferred to a Google server in the USA, where it is stored. This processing occurs due to our overriding legitimate interest in ideally marketing our offers in accordance with Art. 6(1) (f) GDPR.

        Google is certified at:
        https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active

You can find further information on data protection at: https://policies.google.com/privacy?hl=de&gl=de

      3. Google Fonts:

We use third-party fonts provided by Google Fonts to make our website more attractive for visitors. These are loaded from servers of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google") when you visit the website. Google does not store any cookies in your browser during this process. According to our information, however, the IP address of the users device is transferred to Google and stored there.

    8. Social plugins

We use third-party plugins on our websites. With these plugins, you can let your contacts know if you like our online offers and point out or share contents. The plugins are recognisable by the logo of the relevant third-party provider.

When visiting our page, your data is transferred to the relevant third parties.

If you are also a registered user of the third-party site, this data can be linked to the relevant user account on the provider site.

Under certain circumstances, this data may also be transferred to the third-party provider even if you are not a registered user of the third-party service and do not click on the plugin on our pages.

However, if data is transferred while you are not logged in on the third-party site, it is not immediately possible to identify you personally by, for example, using your IP address; this would only be possible with information from your provider.

You can find the purpose and scope of data processing by third-party providers in the privacy policy of the respective provider.

The processing of this data occurs due to our overriding legitimate interest in ideally marketing our online offers in accordance with Art. 6(1) (f) GDPR.

We use plugins from the following providers on our website:

      • YouTube plugin, from Google Inc., located in San Bruno/California, USA

      Certification at: https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active

You can find further information at: https://policies.google.com/privacy?hl=de&gl=de

  3. Data storage period

We only store personal data for as long as it is required for the purposes for which it was processed, or until you withdraw your consent. Where statutory retention obligations apply, the storage period of certain data may be up to ten years, regardless of processing purposes.

  4. Your rights as a data subject
    1. Right to information

You may request information about the personal data we hold that relates to you at no charge and at any time.

    2. Right to rectification, erasure, restriction of processing (blocking), objection

Should you no longer consent to the storage of your personal data or should your personal data become incorrect, we will initiate the erasure or blocking of your data or implement the necessary rectifications (where legally possible) once instructed to do so. The same applies if we should limit our processing of your data in future.

    3. Right to data portability

At your request, we can make your information available to you in a structured, commonly used and machine-readable format, so that you can transmit your data to a different controller if you wish to do so.

    4. Right to appeal

You have the right to appeal to the responsible supervisory authority:

    5. Right to withdraw consent with future effect

You can withdraw your consent with effect for the future at any time. The legality of processing your data remains unaffected by this withdrawal up to the point at which your consent is withdrawn.

    6. Limitations

Data for which we cannot identify the data subject, where, for example, the data was anonymised for analysis purposes, is not subject to the above rights. Information, erasure, blocking, rectification or transfer to a different company may be possible with regard to this data as long as you provide us with additional information that will make identification possible.

    7. Exercising your rights as a data subject

If you have any questions regarding the processing of your personal data, the right to information, rectification, blocking, objection or erasure of data or the desire to transfer data to a different company, please contact Thomas.Falkenburger@apex-toolgroup.com.
